The Supreme Court has annulled the article that regulated the obligation to inform the Treasury about the transfer of housing for tourist use by applying a ruling from the European Court of Justice regarding Airbnb Ireland. Thus, the ruling invalidates the Spanish provision on the basis that the European Commission was not notified of its processing as required.
Administrative contentious room III of the High Court admitted the appeal presented by the Spanish Association of Digital Economy (Adigital) and so annulled the Spanish legislation, imposed in 2017, since its processing was not communicated to the European Commission as required.
